    THE ALGERIAN SUPREME COURT TODAY (WEDNESDAY) COMPLETED ITS HEARING ON WHETHER THE FORMER CONGOLESE PRIME MINISTER, MOISE TSHOMBE, SHOULD BE SENT BACK TO KINSHASA WHERE HE FACES A DEATH SENTENCE FOR TREASON.

    BIG CROWDS GATHERED OUTSIDE THE COURT IN ALGIERS WHERE M. TSHOMBE WAS TAKEN ABOUT THREE WEEKS AGO AFTER A PLANE HE WAS TRAVELLING IN WAS HI-JACKED OVER THE MEDITERRANEAN.

    TODAY HE LOOKED WELL WHEN HE WAS ESCORTED INTO THE COURT BY TWO PLAIN CLOTHES GUARDS.

    THE COURT'S DECISION IS EXPECTED TO BE ANNOUNCED ON FRIDAY MORNING (JULY 21). AFTER THE HEARING, M. TSHOMBE'S COUNSEL TOLD NEWSMEN: "I AWAIT THE DECISION OF THE COURT WITH CONFIDENCE".

    THE COURT'S DECISION WILL HINGE ON WHETHER HIS ALLEGED CRIMES WERE POLITICAL OR CRIMINAL. EXTRADITION -- WHICH HAS BEEN REQUESTED BY THE CONGO-KINSHASA GOVERNMENT OF PRESIDENT JOSEPH MOBUTU -- NORMALLY ONLY COVERS CRIMINAL OFFENCES.

    A LITTLE MORE THAN FIVE MINUTES AFTER THE COURT WENT INTO SESSION, PRESIDENT OULD AOUDIA ORDERED PRESS AND PUBLIC OUT AND THE HEARING CONTINUED IN CAMERA.

    M. TSHOMBE'S COUNSEL MADE A VIGOROUS PLEA FOR THE HEARING TO BE HEARD IN PUBLIC. HE SAID M. TSHOMBE SHOULD BE GIVEN THE CHANCE TO EXPLAIN THAT HE DID NOT MURDER M. PATRICE LUMUMBA, THE FIRST PREMIER OF THE CONGO AFTER IT BECAME INDEPENDENT OF BELGIUM.
