  • Description

Indian Prime Minister Indira Gandhi was given a rousing welcome as she arrived at her home on Friday (7 November) after the Supreme Court unanimously quashed a lower court ruling
that barred her from elective office for six years.

The Supreme Court also declared that her 1971 election to Parliament was valid and upheld a series of changes to the country's election laws.

However, it rejected a key part of the constitutional amendment which her ruling Congress Party had pushed through Parliament. This had declared the earlier High Court verdict against Mrs. Gandhi to be null and void.

Each of the Supreme Court's five senior judges issued his own judgement in a day-long sitting which ended a protracted legal and political battle that had begun with Mrs. Gandhi's election to Parliament with a majority of over 100,000 votes.

She was convicted on 12 June by the Allahabad High Court on two charges of corrupt electoral practice. The charges were brought against her by Mr. Raj Narain, her defeated Socialist disqualification for six years.

Mr. Narain, who has since been jailed under the country's emergency laws, had also challenged the constitutional change and election law amendment introduced to protect the Prime Minister against his original charges.

After the Supreme Court judgement, Mrs. Gandhi made a brief speech to thousands of her supporters assembled outside her residence.

She made no reference to the events at the Court but she denounced her political opponents, saying that they had weakened Indian and that they did not know what democracy was.
