    PRESIDENT JOMO KENYATTA'S RULING KENYA AFRICAN NATIONAL UNION (KANU) PARTY TONIGHT (THURSDAY) PUSHED A CONSTITUTIONAL AMENDMENT THROUGH THE HOUSE OF REPRESENTATIVES. THE AMENDMENT WOULD UNSEAT M.P.'S WHO HAVE RESIGNED FROM THE PARTY.

    THE AMENDMENT, APPROVED BY 95 VOTES TO EIGHT, AFTER A MARATHON NINE-AND-A-HALF HOUR SPECIAL SITTING, COMPELS M.P'S RESIGNING FROM KANU TO SURRENDER THEIR PARLIAMENTARY SEATS AND SEEK A FRESH MANDATE FROM THE PEOPLE. THE AMENDMENT WAS OPPOSED THROUGH MOST OF ITS STAGES BY FORMER VICE-PRESIDENT OGINGA ODINGA'S PARLIAMENTARY GROUP, BUT AT THE END ONLY EIGHT OF THE GROUP'S TOTAL STRENGTH OF 14 IN THE LOWER HOUSE WERE LEFT.

    THE LEFT-WING MR. ODINGA CALLED THE BILL AN INTIMIDATORY MEASURE CALCULATED "TO STIFLE THE OPPOSITION WE ARE ABOUT TO FORM." (KENYA HAS BEEN A ONE-PARTY STATE SINCE 1964.) HE ADDED: "IF THE GOVERNMENT CLOSES OUR MOUTHS, IT WILL BE DRIVING US TO BE SUBVERSIVE." MR. ODINGA RESIGNED RECENTLY FROM KANU TO HEAD AN OPPOSITION GROUP. TWENTY-NINE OTHER M.P.'S ALSO QUIT, BUT AT LEAST 12 WITHDREW THEIR RESIGNATIONS LATER.

    THE HOUSE'S APPROVAL MEANT THE AMENDMENT WOULD GO BEFORE THE SENATE FOR ENDORSEMENT. IT WOULD THEN REQUIRE FORMAL APPROVAL BY PRESIDENT KENYATTA. ONCE IT BECOMES LAW, THOSE WHO RESIGNED FROM KANU EARLIER THIS MONTH LOSE THEIR SEATS.
