    THE MASSACHUSETTS SUPREME COURT ISSUED AN ORDER YESTERDAY (THURSDAY, APRIL 23) GIVING THE SUFFOLK SUPERIOR COURT AUTHORITY TO DECIDE HOW TO RELEASE THE MARY JO KEPECHNE INQUEST PAPERS. THE SUPREME COURT ORDER CAME LESS THAN TWO HOURS AFTER AN ATTORNEY FOR SENATOR EDWARD KENNEDY ASKED THE SUPREME COURT TO ORDER RELEASE OF THE ORIGINAL TRANSCRIPT AND JUDGE'S REPORT IN THE CASE.

    KENNEDY'S ATTORNEY ASKED THAT THE ORDER BE MADE SUBJECT TO SUPERIOR COURT RULES TO ENSURE "ORDER AND DECORUM IN THE PUBLIC EXAMINATION" OF THE DOCUMENTS -- THE 764-PAGE TRANSCRIPT OF TESTIMONY TAKEN AT THE INQUEST, AND THE 12-PAGE REPORT OF PRESIDING JUDGE JAMES A. BOYLE.

    PREVIOUS EFFORTS TO RELEASE THE DOCUMENTS HAD BEEN UNSUCCESSFUL BECAUSE OF LEGAL MANOEUVRES BY SIDNEY LIPMAN, THE COURT STENOGRAPHER, OVER THE RIGHT OF DISTRIBUTION OF TRANSCRIPT COPIES.

    THE SUPERIOR COURT DECIDED THAT THE PAPERS "ARE NOW PUBLIC RECORDS AND SHOULD BE PROMPTLY OPENED TO PUBLIC SCRUTINY WHEN NOT IMPOUNDED."
    IN WASHINGTON, SENATOR EDWARD KENNEDY SAID HE HOPED THE PAPERS WOULD NOT LEAD TO A SCANDAL, AND SAID THAT HIS REQUEST FOR THEIR DISCLOSURE WAS CONSISTENT WITH HIS PAST POSITION.
