    ZAMBIA'S HIGH COURT JUDGES WERE MET BY TRUMPETERS AND A GUARD OF HONOUR WHEN THEY ARRIVED FOR THE CEREMONIAL OPENING OF THE APPEAL COURT IN NDOLA ON TUESDAY. LATER THE COURT FREED MR. WHITSON BANDA, THE MAYOR OF LUSAKA, WHO HAD BEEN JAILED FOR SIX MONTHS FOR CONTEMPT OF COURT.

    THE GUARD OF HONOUR WAS INSPECTED BY MR. JUSTICE BLAGDEN, THE CHIEF JUSTICE OF ZAMBIA. THE JUDGE, IN FULL CEREMONIAL ROBES AND WIG, CARRIED A POSY - A CUSTOM DATING FROM THE TIME WHEN CIRCUIT JUDGES CARRIED FLOWERS "TO WARD OFF THE EVIL STENCH" OF UNWASHED PRISONERS KEPT IN DUNGEONS.

    AS THE COURT WENT INTO SESSION THE CONTROVERSY SURROUNDING THE IMPRISONMENT OF MR. BANDA WAS STILL RAGING. TEN DAYS PREVIOUSLY HE HAD BEEN SENT TO PRISON FOR SIX MONTHS BY A HIGH COURT JUDGE IN LUSAKA FOR CONTEMPT OF COURT.

    THE APPEAL COURT RULED ON TUESDAY THAT THE LUSAKA JUDGE HAD ERRED IN CONVICTING THE MAYOR BECAUSE OF A STATEMENT HE WAS ALLEGED TO HAVE MADE TO NEWSPAPER REPORTERS ABOUT THE CLOSURE OF A LUSAKA BUTCHERY.

    LUSAKA CITY COUNCIL ORDERED THE BUTCHERY TO BE CLOSED ON HEALTH GROUNDS AFTER AN ALLEGED INCIDENT IN WHICH MRS. REUBEN KAMANGA, WIFE OF ZAMBIA'S VICE-PRESIDENT, WAS SERVED WITH ROTTEN MEAT. MR. EUSTAGE MUMBA, A BRANCH OFFICIAL OF THE RULING UNITED NATIONAL INDEPENDENCE PARTY, WHO WAS JAILED FOR A YEAR ON A SIMILAR CHARGE BY THE SAME JUDGE WAS FREED AFTER SERVING A WEEK IN PRISON. THE ORDER TO FREE HIM CAME FROM DR. KENNETH KAUNDA, THE PRESIDENT OF ZAMBIA.

    LATER DR. KAUNDA HAD A MEETING WITH MR. JUSTICE BLAGDEN, WHO HAD EXPRESSED THE JUDGES' "GREATEST CONCERN" OVER MR. MUMBA'S RELEASE. DR. KAUNDA SAID MR. JUSTICE BALGDEN HAD TOLD HIM OF THE JUDGES ANXIETY THAT THE REMISSION OF MR. MUMBA'S SENTENCE COULD BE INTERPRETED AS A LACK OF CONFIDENCE IN THE JUDICIARY.

    DR. KAUNDA SAID IN A STATEMENT ISSUED AFTER THE MEETING THAT THE REMISSION OF SENTENCE WAS IN NO WAY A CRITICISM OF THE TRIAL JUDGE'S FINDINGS. AND HE REAFFIRMED HIS COMPLETE FAITH IN THE JUDICIARY.
