Background: Visnews filmed outside the Law Courts, Nairobi, Jan 26 as 71 yrs old Q.C. Mr. D.N. Pritt arrived with Mr. Kapila to defend Rawson Mbogwa Macharia charged with swearing a false affidavit at the 1952 Kapenguria trial of Jomo Kenyatta.
Macharia pleaded not guilty.
At the hearing Jan 26, advocate M.K.Bhandari said the affidavit had been sworn before him, but was unable to produce the original document. Nor was the defense able to produce it. Tom Mboya was summoned to appear Jan 27 to state where the affidavit could be produced.
When the magistrate reminded Macharia at the start of the proceedings that he was only required to plead, Macharia said, 'I think you are trying to frighten me, but I am not a man who is easily frightened.'
The case is expected to run for 30 days, during which time Macharia has been remained in custody.
