SENOR MARIANO ROBLES ROMERO, DEFENDING THE 31 YEAR-OLD DUCHESS, QUESTIONED THE NEED FOR U.S. BASES IN SPAIN AND ATTACKED THE AGREEMENT UNDER WHICH THEY WERE ESTABLISHED.

    THE DUCHESS, A DESCENDANT OF ONE OF SPAIN'S OLDEST NOBLE FAMILIES, IS CHARGED WITH ORGANISING AN ILLEGAL DEMONSTRATION OF VILLAGERS OF PALOMARES, SOUTHERN SPAIN, WHERE FOUR U.S. HYDROGEN BOMBS FELL LAST YEAR AFTER A MID-AIR COLLISION.

    IN HIS SUMMING UP, SENOR ROBLES PROTESTED THAT SPANIARDS SUFFERING THROUGH THE AMERICAN PRESENCE COULD ONLY CLAIM REDRESS FROM UNITED STATES AUTHORITIES AND HAD NO RECORD TO SPANISH COURTS. WHEN THE BILATERAL CASES AGREEMENT CAME UP FOR RENEWAL NEXT YEAR, SPAIN SHOULD ENSURE THAT COMPLAINTS INVOLVING THE ACTIVITIES OF THE U.S. FORCES IN SPAIN SHOULD COME UNDER THE JURISDICTION OF SPANISH COURTS, HE ADDED.

    THE DEFENCE LAWYER ARGUED THAT PALOMARES VILLAGERS HAD ONLY RECEIVED A SMALL PROPORTION OF THE COMPENSATION THEY HAD CLAIMED FOR CROPS, LAND, AND LIVESTOCK DAMAGED IN THE SEARCH FOR THE BOMBS.

    THE DUCHESS AND NINE WITNESSES SAID THEY HAD NOT PLANNED A DEMONSTRATION, BUT AN "EXCURSION" TO THE UNITED STATES EMBASSY IN MADRID TO CLAIM COMPENSATION.

    CALLED THE "RED DUCHESS" FOR PREVIOUS SOCIAL CRUSADES, SHE TOLD THE COURT: "ANY TIME A SPANIARD IS UNABLE TO HAVE RECOURSE TO THE SPANISH COURTS I WILL BE AT HIS DISPOSAL."
    SO FAR THE UNITED STATES HAS PAID OUT 613,000 DOLLARS (219,000 STERLING) FOR DAMAGE CAUSED BY THE BOMBS. BUT LAWYERS FOR SOME OF THE VILLAGERS ARE STILL TRYING TO OBTAIN MORE THAN ONE MILLION DOLLARS (357,000 STERLING) COMPENSATION FOR DAMAGE.

    THE TRIAL ENDED TODAY AFTER A 90 MINUTE HEARING, SENTENCE IS EXPECTED TO BE ANNOUNCED WITHIN THE NEXT FEW DAYS.
