Whether or not there is contained within the transcripts at this time reversible errors, you know, of prejudicial scope, is difficult to determine. But in the unlikely event that the defendants are convicted, and an appeal follows, I'm sure there are going to be numerous points to be raised on appeal, and certainly this is going to be one of them."

Background: Mr. Paul Fitzgerald, one of the defence attorneys in the trial of Charles Manson and three of his girl followers, spoke to reporters on Wednesday (August 5) about the recent developments in the trial. But a defence motion calling for a mistrial was denied by Judge Charles Older even though the jury were shown the newspaper headline "Manson Guilty -- Nixon declares".
The jury saw the headline when Manson himself picked up a copy of the newspaper and held it before them. The headline referred to President Nixon's statement on Monday (August 3) when he said: "Here is a man (Manson) who is quilty, directly or indirectly, of eight murders without reason." The statement was later retracted.
The Judge turned down a defence plea for a mistrial after deciding that the jury could still be fair and impartial in their judgement of the case. One of the defence lawyers, Daye Shin was sentenced to three nights in prison on contempt charges for leaving the paper on the defence table. He is the third defence attorney to be jailed since the trial began eight weeks ago.
