    THE 44-YEAR-OLD EDWARD S. DINIS, A DISTRICT ATTORNEY NOTED FOR HIS AGGRESSIVE COURTROOM STYLE, SUFFERED AN APPARENT SETBACK WHEN WE LEARNED MONDAY THAT DR. ROBERT V. NEVIN, THE EDGARTOWN MEDICAL EXAMINER WHO SUPPORTED DINIS' REQUEST FOR EXAMINATION OF MISS MARY JO KOPECHNE'S BODY, WITHDREW HIS SUPPORT OF THE COURT PETITION.

    THE EFFECT, IF ANY, OF NEVIN'S TURN ABOUT WILL NOT BE KNOWN UNTIL AN EXPECTED RULING TUESDAY OR WEDNESDAY BY PRESIDENT JUDGE BERHARD C. EROMINSKI OF THE LUZERNE COUNTY, PA., COMMON PLEAS COURT.

    DENIS IS SEEKING EXHUMATION AND AUTOPSY OF MISS KOPECHNE'S BODY TO DETERMINE ONCE AND FOR ALL THE MEDICAL CAUSE OF HER DEATH, AT FIRST ESTABLISHED AS DROWNING. THE INQUEST WILL TRY TO ESTABLISH A LEGAL CAUSE OF DEATH, AND DINIS SAID THE AUTOPSY IS VITAL TO ACCOMPLISH THIS.

    MARY JO KOPECHNE WAS TRAVELLING IN SENATOR EDWARD M. KENNEDY'S CAR WHEN THE ACCIDENT HAPPENED ON CHAPPAQUIDICK ISLAND.

    IN WITHDRAWING HIS SUPPORT NEVIN SAID, "THE SANDS OF TIME HAVE SHIFTED AND THE RELATIVE VALUE OF FORCES HAVE SHIFTED. AN AUTOPSY WOULD HAVE PROVIDED A COMPLETENESS WHICH CAN NEVER BE DETERMINED WITHOUT IT" BUT "I ALSO FEEL THAT AS TIME GOES ON THE RELATIVE VALUE OF THINGS TO BE GAINED HAVE DIMINISHED."
    NEVIN WAS ON VACATION WHEN THE ACCIDENT HAPPENED AND AN ASSOCIATE MEDICAL EXAMINER, DR. RONALD R. MILLS, MADE THE RULING OF DEATH BY DROWNING.
