    THE TRIAL OF JACK RUBY, WHO IS ACCUSED OF MURDERING LEE HARVEY OSWALD, PRESIDENT KENNEDY'S ALLEGED ASSASSIN, OPENED IN DALLAS ON WEDNESDAY.

    THE OPENING WAS PRECEDED BY TWO WEEKS OF COURT PRELIMINARIES DURING WHICH FOURTEEN JURORS WERE SWORN IN AFTER MORE THAN SIXTY HOURS OF HEARINGS. THE DEFENCE CONSTANTLY CALLED FOR THE MOVING OF THE TRIAL TO A PLACE AWAY FROM DALLAS, AND CLAIMED THAT IMPARTIAL JURORS COULD NOT BE FOUND IN THE CITY WHERE PRESIDENT KENNEDY DIED.

    WHEN THE TRIAL PROPER OPENED ON WEDNESDAY, JACK RUBY, A NIGHTCLUB OPERATOR, PLEADED 'NOT GUILTY' TO CHARGES OF MALICIOUSLY MURDERING OSWALD. THE PLEA, TO WHICH DEFENCE COUNSEL ADDED THE REMARK THAT RUBY WAS ALSO PLEADING GUILTY BY REASON OF INSANITY, CAME AFTER JUDGE J.B. BROWN HAD OVERULLED A NUMBER OF DEFENCE SUBMISSIONS. THE DEFENCE HAD CONTINUED THEIR MOVE FOR A CHANGE OF VENUE FOR THE TRIAL ON GROUNDS THAT RUBY WOULD NOT GET A FAIR HEARING IN DALLAS.

    TWO PROMINENT WITNESSES CALLED DURING THE FIRST TWO DAYS OF THE TRIAL WERE DETECTIVE D.R. ARCHER AND DETECTIVE THOMAS MACMILLAN. ARCHER TESTIFIED THAT AS RUBY CAME AT OSWALD, GUN IN HAND, HE WAS MUTTERING. AFTER THE SHOOTING, SAID ARCHER, HE HEARD RUBY SAY HE HOPED HE HAD KILLED OSWALD. MACMILLAN SUBSTANTIATED THIS TESTIMONY.

    THE QUESTION OF WHICH FINGER RUBY USED TO PULL THE TRIGGER HAS BECOME A LEADING QUESTION FOR THE DEFENCE. THEY CLAIM RUBY PULLED THE TRIGGER WITH HIS SECOND FINGER WHILE HE WAS SUFFERING FROM BLACKOUT BROUGHT ABOUT BY A SUDDEN ATTACK OF PSYCHOMOTOR EPILEPSY.
