    THE TREASON TRIAL OF FORMER CONGOLESE PRIME MINISTER MOISE TSHOMBE, WHO NOW LIVES IN MADRID, BEGAN BEFORE A SPECIAL MILITARY TRIBUNAL IN KINSHASA ON MONDAY (MARCH 6). M. TSHOMBE WAS NOT PRESENT AT THE TRIAL, BUT SIX OTHER ALSO ACCUSED OF TREASON WERE IN COURT.

    THE CHARGES AGAINST TSHOMBE, ACCORDING TO AN INDICTMENT READ IN COURT, REFERRED TO HIS PART IN THE SECESSION OF KATANGA PROVINCE, OF WHICH HE WAS PRESIDENT, FROM JULY 1960 TO JANUARY 1963. HE WAS ALSO ACCUSED OF INSTIGATING A MUTINY IN KISINGANI (FORMERLY STANLEYVILLE) IN THE SUMMER OF LAST YEAR, AND OF RECRUITING FOREIGN MERCENARIES IN AN ATTEMPT TO OVERTHROW THE LEGAL CONGOLESE GOVERNMENT.

    THE STATE PROSECUTOR, M. ALIDOR KABEYA, ALSO ANNOUNCED THAT ANOTHER CHARGE WOULD BE PREFERRED AGAINST TSHOMBE LATER FOR HIS ALLEGED PART IN THE DEATH OF THE CONGO'S FIRST PRIME MINISTER, M. PATRICE LUMUMBA. PATRICE LUMUMBA WAS MURDERED IN ELISABETHVILLE (NOW LUMUMBASHI), THE CAPITAL OF KATANGA, IN JANUARY, 1961, WHEN TSHOMBE OF SECESSIONIST KATANGA.

    THE OTHER SIX ACCUSED WERE: LIEUTENANT-COLONEL FERDINAND TSHIMPOLA, COMMANDER OF THE REGIMENT OF KATANGESE GENDARMES WHO REBELLED AGAINST THE CENTRAL GOVERNMENT IN JULY 1966; CAPTAIN EMMANUEL BANZA; CAPTAIN KALONDA-MOANDA; CAPTAIN LOUIS MUTONO; LIEUTENANT DENNIS MBABU AND A CIVILIAN, M. EMERY LUTHER KATTENG, FORMER HEAD OF CABINET AT THE MINISTRY OF SOCIAL AFFAIRS, WHO ASKED FOR A DEFENCE COUNSEL.

    THE PROSECUTOR AGREED TO FIND M. KATTENG A LAWYER, AND IT WAS ALSO EXPECTED THAT THE STATE WOULD POINT A DEFENCE COUNSEL FOR M. TSHOMBE IF HE DID NOT CHOOSE ONE HIMSELF.

    THE COURT HEARD EVIDENCE FROM THE SIX DEFENDANTS PRESENT DURING THE FOUR-AND-A-HALF SESSION. ALL THE ACCUSED ARE LIABLE TO THE DEATH PENALTY.

    THE TRIAL IS BEFORE A TRIBUNAL OF THREE SENIOR ARMY OFFICERS - COLONEL PIERRE INGILA, PRESIDENT, COLONEL FERDINAND MALILA AND LIEUTENANT HONORE NKULUFA. IT IS BEING HELD AT KOKOLA CAMP ON THE OUTSKIRTS OF KINSHASA, WHERE A SIMILAR COURT LAST MAY IMPOSED THE DEATH PENALTY ON FOUR LEADING CONGOLESE POLITICIANS - INCLUDING ANOTHER PRIME MINISTER, M. EVARISTE KIMBA.

    THE HEARING WAS ADJOURNED UNTIL NEXT MONDAY. SINCE THEN IT HAS BEEN REPORTED FROM KINSHASA THAT M. TSHOMBE ELDER BROTHER, THOMAS, HAS BEEN SUMMONED TO APPEAR AS A WITNESS. AND THE CONGOLESE GOVERNMENT HAS OFFERED MOISE TSHOMBE AN AIRCRAFT TICKET FROM MADRID TO KINSHASA SO THAT HE CAN ATTEND THE TRIAL.

    LAST MONDAY, M. TSHOMBE WAS NOT AVAILABLE FOR COMMENT AT HIS MADRID APARTMENT.
