    NAHASHON ISAAC NJENGA NJOROGE, UNDER SENTENCE OF DEATH FOR THE MURDER OF KENYA ECONOMICS MINISTER TOM MBOYA, HEARD HIS APPEAL AGAINST CONVICTION AND SENTENCE DISMISSED YESTERDAY (13 OCTOBER).

    THE APPEAL WAS HEARD AT THE EAST AFRICAN COURT OF APPEALS IN NAIROBI HIGH COURT BUILDING. A STRONG POLICE GUARD SURROUNDED THE COURT, AND ONLY JOURNALISTS WERE ALLOWED IN THE PUBLIC GALLERY AS NJOROGE APPEARED, HANDCUFFED, TO A POLICE OFFICER.

    HE WAS REPRESENTED BY MR. SAMUEL WARUHIU, HIS DEFENCE COUNSEL IN HIS HIGH COURT TRIAL LAST MONTH. THE REPUBLICA WAS REPRESENTED BY MR. KENNETH PORTER, KENYA'S SPECIAL LEGAL AND CONSTITUTIONAL ADVISER.

    THE THREE JUDGES WHO REJECTED NJOROGE'S APPEAL WERE SIR CHARLES NEWBOLD, PRESIDENT OF THE APPEAL COURT, VICE-PRESIDENT MR. JUSTICE DUFFUS, AND MR. JUSTICE SPRY.

    NJOROGE'S WIFE AND A NUMBER OF RELATIVES WERE PRESENT AT THE HEARING. ALSO PRESENT WAS MR. JOHN BELL, HEAD OF THE NAIROBI CRIMINAL INVESTIGATION DEPARTMENT.

    AFTER THE DISMISSAL, NJOROGE WAS TAKEN BACK TO HIS CONDEMNED CELL IN KAMITI PRISON IN A HEAVILY GUARDED PRISON TRUCK.
