ON 4 AUGUST 1974, THE CABINET DECIDED THE FOLLOWING: "IT IS RESOLVED: THAT THE CABINET DECISION NUMBER OF 22 OF 29 OCTOBER 1967 WILL STAND, ACCORDING TO WHICH AN ORDER WAS GIVEN TO THE ATTORNEY GENERAL AND THE MILITARY ADVOCATE GENERAL THAT THE ADVOCATES AND MILITARY PROSECUTORS WHO APPEAR IN THE COURTS AND THE MILITARY COURTS WILL ANNOUNCE IN REGARD TO SENTENCING THAT THEY DO NOT DEMAND THE IMPOSITION OF THE DEATH PENALTY OF THE DEFENDANTS.

    THE CABINET DISCUSSED THE PROPOSAL OF THE PRIME MINISTERS CONCERNING THE AUTHORIZATION OF PROSECUTORS TO DEMAND THE IMPOSITION OF THE DEATH PENALTY AGAINST TERRORISTS WHO PERPETRATE ACTS OF INHUMAN CRUELTY, AND MADE THE FOLLOWING DECISION:



    "IT IS RESOLVED: TO ANNUL CABINET DECISION NUMBER 22 OF 29 OCTOBER 1967, CABINET DECISION NUMBER 820 OF 4 AUGUST 1974, AND CABINET DECISION NUMBER 459 OF 22 FEBRUARY 1976."

    THE CHIEF OF STAFF REPORTED ON OPERATIONS WHICH THE I.D.F. HAS UNDERTAKEN AGAINST TERRORISTS IN SOUTHERN LEBANON.

    THE PRIME MINISTER REPORTED ON THE LIBERATION OF PRISONERS OF ZION FROM THE SOVIET UNION.

    THE CABINET HEARD AN ACCOUNTING BY THE ATTORNEY GENERAL REGARDING THE JUDICIAL DELIBERATIONS BEFORE THE HIGH COURT OF JUSTICE ON THE MATTER OF THE LAGIYEH LANDS. THE PRIME MINISTER CONCLUDED THE SESSION BY STATING: "THE CABINET UPHOLDS THE PRINCIPLE OF THE SUPERIORITY OF THE JUDICIARY OVER ANY OF THE OPERATIONAL SERVICES OF THE STATE, INCLUDING THE CABINET ITSELF. I REQUEST THE MINISTERS TO TAKE CARE THAT THE AUTHORITIES WILL FULFILL WITHOUT HESITATION THE ORDERS OF THE COURT AND CARRY THEM OUT FAITHFULLY."

    ON 22 FEBRUARY 1976, THE CABINET DECIDED THE FOLLOWING: "IT IS RESOLVED: IN CONTINUATION OF DECISION NUMBER 820 OF 4 AUGUST 1974, TO AUTHORIZE THE COMMITTEE APPOINTED BY THE PRIME MINISTER, ACCORDING TO A DECISION OF 17 MARCH 1974, TO DECIDE BY AUTHORITY OF THE CABINET, THAT THE MILITARY ADVOCATE WILL BE PERMITTED TO REQUEST THE IMPOSITION OF THE DEATH PENALTY BY THE MILITARY COURT IN THE CONCRETE MATTER WHICH THE PRIME MINISTER WILL BRING BEFORE THE COMMITTEE."
    IT HAS NOW BEEN DETERMINED THAT ALL THREE DECISIONS REFERRED TO HAVE BEEN ANNULLED.
