    PRESTON COBB, A 15 YEAR OLD NEGRO WHO IS UNDER SENTENCE OF DEATH FOR THE MURDER OF A 70 YEAR OLD WHITE FARMER, HEARD THE JUDGE AT THE BALDWIN COUNTY COURTHOUSE, MILLEDGEVILLE, GEORGIA, OCTOBER 6, POSTPONE A DECISION ON WHETHER TO ALLOW HIM A NEW TRIAL.

    THE BOY WAS BROUGHT FROM HIS DEATH CELL AT REIDSVILLE STATE PRISON, WHERE HE HAD BEEN DUE TO DIE IN THE ELECTRIC CHAIR ON SEPTEMBER 22. BUT HE WAS GRANTED A "STAY OF EXECUTION" AND ON OCT 6 HIS LAWYER ARGUED THE CASE FOR A NEW TRIAL. COBB WAS CONVICTED OF THE MURDER OF COLEMAN DUMAS, OF MONTICELLO. IT WAS ALL SAID THAT COBB WALKED INTO DUMAS' HOUSE AND SHOT HIM AFTER AN ARGUMENT OVER A FISH.

    COBB'S MOTHER WAS IN COURT TO WATCH THE PROCEEDINGS. SHE TALKED TO TWO OFFICIALS FROM HOLLAND WHO CAME AS REPRESENTATIVES OF THE "NETHERLANDS COMMITTEE FOR PRESTON COBB." THE DUTCH OFFICIALS ARE DR. B.W. VAN HOUTEN, A CHILDREN'S COURT JUDGE FROM ARNHEM, AND MRS. S.T. DIEMER-LINDEBOOM, A MEMBER OF THE ROTTERDAM BOARD OF SUPERVISORS. THEY BROUGHT A PETITION URGING THAT COBB NOT BE ELECTROCUTED. THEY SAY THEY ARE INTERESTED IN THE NEGRO BOY BECAUSE OF HIS AGE - NOT HIS RACE.

    ATLANTA LAWYER, D.L. HOLLOWELL, A NEGRO, REPRESENTED COBB. HE ENTERED THE CASE AT THE REQUEST OF THE NATIONAL ASSOCIATION FOR THE ADVANCEMENT OF COLOURED PEOPLE. HE BASED HIS PETITION FOR A NEW TRIAL ON THE CONTENTION THAT NEGROES HAVE BEEN SYSTEMATICALLY EXCLUDED FROM JURY DUTY IN JASPER COUNTY - THE LOCATION OF COBB'S FIRST TRIAL.

    EFFORTS TO GET COBB A NEW TRIAL MET STRONG RESISTENCE FROM THE PROSECUTOR, GEORGE D. LAWRENCE. HE ARGUED THAT ATTORNEY HOLLOWELL HAD NOT BEEN "PROPERLY RETAINED." ALSO, LAWRENCE SAID HOLLOWELL DID NOT PRESENT ANY NEW EVIDENCE THAT WOULD WARRANT COBB GETTING A NEW TRIAL. THE CONDEMNED BOY WILL HAVE TO WAIT AT LEAST 30 DAYS TO FIND OUT IF HE WILL GET A NEW TRIAL. JUDGE CARPENTER GAVE LAWYERS IN THE CASE UNTIL OCTOBER 26 TO FILE FURTHER AFFIDAVITS IN THE CASE.

    IN THE MEANTIME, COBB WILL REMAIN AT THE BALDWIN COUNTY JAIL IN MILLEDGEVILLE.
