    THE FINANCIAL EDITOR OF THE RHODESIA HERALD, MR. JOHN NICHOLSON, WAS JAILED FOR 18 MONTHS YESTERDAY (WEDNESDAY) FOR PASSING INFORMATION ON RHODESIA'S SANCTION-BREAKING OPERATIONS TO A "FOREIGN AGENT".

    MR. NICHOLSON HAD PLEADED GUILTY AFTER A FOUR HOUR TRIAL IN THE HIGH COURT ON TUESDAY (DECEMBER 9) TO TWO CHARGERS BROUGHT UNDER RHODESIA'S EMERGENCY COUNTER ESPIONAGE REGULATIONS AND THE OFFICIAL SECRETS ACT. HE WAS JAILED FOR NINE MONTHS ON EACH CHARGE.

    THE PROSECUTION CLAIMED THAT HE HAD COLLECTED INFORMATION WHICH COULD BE OF USE TO AN ENEMY. HE WAS ALLEGED TO HAVE PASSED INFORMATION TO AN UNIDENTIFIED FOREIGN AGENT BY A LETTER LEFT IN A PRIVATE POST OFFICE BOX IN THE SALISBURY SUBURB OF HIGHLANDS LAST SEPTEMBER. PASSING SENTENCE, JUSTICE HAROLD DAVIES TOLD NICHOLSON THAT HIS CONDUCT "POTENTIALLY AFFECTED THE WELFARE OF EVERYONE IN THIS COUNTRY", AND HIS CONDUCT MUST BE "ABHORRENT TO THE COMMUNITY AS A WHOLE."
    MOST OF THE TRIAL WAS HELD "IN CAMERA" BUT THE JUDGE STATED THAT THE INFORMATION WAS "NOT OF A PARTICULARLY VITAL NATURE." THE INFORMATION, HE ADDED, INCLUDED THE IMPACT ON THE RHODESIAN ECONOMY OF UNITED NATIONS MANDATORY SANCTIONS IMPOSED IN 1968. THE JUDGE WAS ASSISTED IN THE CASE BY TWO ASSESSORS.

    MR. NICHOLSON, AGED 38, WAS BORN IN DUNDEE, UNITED KINGDOM. THE CONVICTION COMES SOON AFTER THE ANNOUNCEMENT BY RHODESIAN PRIME MINISTER IAN SMITH, THAT THE FIRST GENERAL ELECTIONS UNDER RHODESIA'S NEW REPUBLICAN CONSTITUTION WOULD BE IN APRIL NEXT YEAR.
