    BOTH THE AUSTRIAN TOURING CLUB AND THE AUSTRIAN REPUBLIC CLAIM TO BE LEGAL OWNERS OF THE SO-CALLED MARCUS CAR, NAMED AFTER ITS INVENTOR, SIEGFRIED MARCUS.

    THE TOURING CLUB'S CASE IS THAT THEY BOUGHT THE CAR IN 1898 AND LENT IT TO THE TECHNICAL MUSEUM IN 1918, WHERE IT HAS BEEN ON EXHIBITION EVER SINCE. THREE YEARS AGO MEMBER OF THE TOURING CLUB WANTED PHOTOGRAPHS OF THE CAR AT THE MUSEUM, AND THEY WERE CHARGED A FEE. THEY WEREMEOL THIS TO BE A MISTAKE AS THE CAR BELONGED TO THEM, BUT GREATER STILL WAS THEIR SURPRISE WHEN THE ZMUSBUM PRODUCED A DOCUMENT, DATED 1938 STATING THAT THE CLUB WAS DONATING THE CAR TO THE MUSEUM.

    THEY WERE TOLD THAT AFTER AUSTRIA'S ANNEXATION BY NAZI GERMANY WHEN THE AUSTRIAN TOURING CLUB WAS LIQUIDATED AND INCORPORATED INTO THE SO-CALLED "NATIONAL SOCIALIST MOTORING CORPS", THE MARCUS CAR WAS GIVEN TO THE MUSEUM "AS A GIFT" BY THE NAZI REPRESENTATIVE DELEGATED TO TRANSFER. THE CLUB'S VIENNA OFFICE TO MUNICH.

    TODAY, BOTH THE TECHNICAL MUSEUM - CONTROLLED BY THE AUSTRIAN REPUBLIC - AND THE AUSTRIAN TOURING CLUB - RE-FOUNDED AFTER WORLD WAR TWO - CLAIM LEGAL OWNERSHIP. AS NO AMICABLE SETTLEMENT COULD BE REACHED, THE TOURING CLUB TOOK THE CASE TO COURT EARLY THIS EAR. ON FEB. 1, AN AUSTRIAN COURT RULED THAT THE CAR BELONGED TO THE AUSTRIAN REPUBLIC SINCE THE DONATION DOCUMENT OF 1938 WAS VALID, AND THE TIME FOR CLAIMS UNDER THE NAZI REPARATION ACT HAD EXPIRED. THE TOURING CLUB APPEALED.

    DURING THE DISPUTES, THE CAR ITSELF SEEMS TO HAVE BEEN FORGOTTEN. VALUED BY THE COURT AT ONLY GBP200, THE MARCUS CAR HAS A FOUR-STROKE, ONE-CYLINDER ENGINE WITH A BORE OF 100-MILLIMETRES, A 200-MILLIMETRE STROKE, AND 1,570 C.C.CAPACITY. ITS MAXIMUM POWER IS GIVEN AS 0.75 HORSE-POWER, AND THE MAXIMUM SPEED ON "AVERAGE ROADS" IS CLAIMED TO BE FIVE TO SIX KILOMETRES (ABOUT THREE MILES) AN HOUR. ALTHOUGH CLAIMS TO HAVE INVENTED THE FIRST MOTORCAR DATED BACK TO 1770, MARCUS WAS THE FIRST PERSON TO USE PETROL AS FUEL FOR A MOTOR-CAR ENGINE, THE OTHERS WERE DRIVEN BY STEAM OR GAS.
