THE HEARING IN THE APPELLATE DIVISION WAS ON THE CRUCIAL POINT OF WHETHER THE HIGH COURT ACCEPTED THE DE JURE AUTHORITY OF THE SMITH REGIME OR REGARDED ITSELF AS STILL SUBJECT TO THE AUTHORITY OF THE DISCARDED 1961 CONSTITUTION AND THE BRITISH PRIVY COUNCIL, THE HIGHEST COURT OF APPEAL IN THE COMMONWEALTH.

    THE HEARING WAS OF AN APPEAL BY 32 AFRICANS AGAINST DEATH SENTENCES. THEY ARE CHALLENGING THEIR CONVICTION FOR ENTERING THE COUNTRY WITH ARMS OF WAR AND BASE THEIR APPEAL ON THE BRITISH PRIVY COUNCIL RULING LAST MONTH THAT THE RHODESIAN REGIME AND THE LAWS IT PASSED SINCE IT SEIZED INDEPENDENCE IN 1965 ARE ILLEGAL. THE CASE IS SEEN AS A CRUCIAL AND POSSIBLY FINAL STAGE IN THE REGIME'S BATTLE FOR RECOGNITION OF ITS LEGALITY BY ITS JUDICIARY. A DECISION ON THE CASE IS EXPECTED THIS WEEK.
