  • Description

The West German Constitutional Court on Tuesday (25 February) rejected a law legalising abortions during the first three months of pregnancy. Within hours of the decision being made public, demonstrations broke out in a number of cities.

The court ruled that the constitution guaranteed the right of life to all... either born or unborn.

Of the eight judges on the bench, only two upheld the abortion law, one of them a married woman. Under present law abortions can be performed during the first three months of pregnancy in cases of rape or on grounds of health or hardship.

As a result of the judgement, abortion except for these reasons, remains a criminal offence punishable by up to five years jail.

The Bundestag last June approved a law legalising abortions by a majority of nearly 150 votes... by the Opposition Christian Democrat groups, having strong church links, appealed to the Constitutional Court.
